Terms and Conditions – ArtyFacts VOF

This document constitutes the general sales terms and conditions of ArtyFacts VOF.

These terms and conditions apply to every offer from and every agreement with ArtyFacts VOF (hereinafter "ArtyFacts", "we" or "us"), relating to the products and services offered via the website.

By placing an order, the customer (hereinafter "the Customer") declares acceptance of these terms.

2. Applicability

These terms apply to all offers, orders and agreements via the ArtyFacts website. Deviations are only valid if agreed in writing.

3. Offer and products

ArtyFacts offers:

  • Boxes in which customers can collect drawings
  • Digitisation of these drawings
  • Creation of personalised products (such as photo books and calendars)
  • In the future: additional personalised products

ArtyFacts strives for the most accurate possible representation of products, but minor deviations are possible.

4. Order and agreement

An agreement is concluded when:

  • The Customer places an order via the website
  • ArtyFacts confirms this order

ArtyFacts reserves the right to refuse orders, for example in the case of:

  • Incomplete information
  • Misuse or fraud

5. Prices and payment

  • All prices are stated in euros and include VAT (unless otherwise indicated)
  • Shipping costs may be charged separately
  • Payment is made via the offered payment methods

ArtyFacts reserves the right to adjust prices.

6. Delivery and processing

6.1 Shipping

  • The box is delivered to the specified address
  • The Customer is responsible for correct address details

6.2 Return shipment

  • The Customer returns the box with drawings according to the instructions
  • The risk of shipment lies with the Customer until receipt by ArtyFacts

6.3 Processing

After receipt:

  • the drawings are digitised
  • processed into the chosen product

Delivery times are indicative and not binding.

7. Right of withdrawal

7.1 General rule

The Customer has the right to withdraw from the purchase within 14 days.

7.2 Exception

The right of withdrawal does not apply to:

  • Personalised products
  • Products made to order

This follows from Belgian consumer protection legislation.

8. Responsibility for supplied content

The Customer declares that:

  • he/she is the owner of the supplied drawings, or
  • has the necessary rights

The Customer guarantees that the content:

  • does not infringe the rights of third parties
  • does not contain unlawful or inappropriate content

ArtyFacts is not liable for content supplied by the Customer.

9. Intellectual property

9.1 Customer content

Ownership of the drawings remains with the Customer. By supplying these:

  • the Customer grants a limited licence to ArtyFacts to process them for the performance of the service

9.2 ArtyFacts content

All content on the website (texts, logos, designs) remains the property of ArtyFacts and may not be copied without permission.

10. Retention of drawings

  • Digital files: retained for a maximum of 1 year
  • Physical drawings: maximum 6 months, unless returned earlier

After this period:

  • files may be deleted
  • ArtyFacts is not obliged to retain them any longer

11. Liability

ArtyFacts is only liable for:

  • direct damage caused by intent or gross negligence

ArtyFacts is not liable for:

  • loss or damage during shipment by third parties
  • indirect damage (such as loss of profit or data)

Liability is in any case limited to the amount of the order.

12. Force majeure

ArtyFacts is not liable for delays or non-performance due to force majeure, such as:

  • strikes
  • technical failures
  • transport problems

13. Privacy and data protection

ArtyFacts processes personal data in accordance with the privacy policy. For more information: see our Privacy Policy on the website.

14. Complaints

Complaints can be reported via: arty@artyfacts.club. We aim to respond within a reasonable time.

15. Applicable law and competent court

  • These terms are governed by Belgian law
  • Disputes fall under the jurisdiction of the courts of the district where ArtyFacts is established
